1. Introduction & Overview

Welcome to Nook. These Tenant Terms (“Terms”) govern your access to and use of Nook's residential properties, common spaces, platform services, and associated amenities. By signing a Lease Agreement, accessing a Nook property, or using our digital tenant portal, you agree to comply with and be bound by these Terms.

Please read these Terms carefully. They constitute a legally binding agreement between you (“Tenant”, “Resident”, or “You”) and Nook Operations Inc. (“Nook”, “We”, “Us”, or “Our”).

2. Occupancy & Residency Standards

2.1 Permitted Occupants

Only individuals explicitly listed on the Lease Agreement as authorized tenants or occupants are permitted to reside in the designated unit.

  • Primary Tenant: Must be at least 18 years of age and assumes full legal and financial responsibility for the unit.
  • Occupants: Any additional residents named in the Lease Agreement must abide by all house rules and community guidelines.
  • Subletting & Assignment: Subletting, short-term rentals (e.g., Airbnb, VRBO), or assigning the lease to third parties without prior written consent from Nook management is strictly prohibited.

2.2 Guest Policy

Nook welcomes guests, subject to the following regulations to ensure security and comfort for all community members:

  • Short-Term Guests: Overnight guests are permitted for up to three (3) consecutive nights without prior authorization.
  • Extended Stays: Any guest staying longer than seven (7) consecutive days or more than fourteen (14) days in a calendar month requires written approval from Nook management and may be subject to background verification.
  • Tenant Responsibility: Tenants are fully liable for the conduct, actions, and any damages caused by their guests while on property grounds.

3. Rent Payments & Financial Obligations

3.1 Due Dates & Payment Methods

Rent is due on the first (1st) day of each calendar month. Payments must be submitted through the official Nook Tenant Portal unless an alternative method has been formally agreed upon in writing.

Bank debits and recurring payments made through the portal are also governed by the Nook Payments, ACH & AutoPay Terms.

3.2 Utilities & Service Charges

Unless explicitly included in your Lease Agreement, tenants are responsible for setting up and paying for all applicable utilities, including electricity, gas, water, and internet services. Utilities provided by Nook will be billed monthly via the tenant portal.

4. Community Rules & Code of Conduct

To maintain a quiet, clean, and enjoyable environment for all residents, tenants agree to strictly follow the community standards outlined below.

4.1 Quiet Hours & Noise Rules

  • Standard Quiet Hours: Sunday through Thursday, 10:00 PM – 7:00 AM.
  • Weekend Quiet Hours: Friday and Saturday, 11:00 PM – 8:00 AM.
  • During quiet hours, music, televisions, and general noise levels must be kept low enough so as not to disturb neighboring units.

4.2 Common Areas & Shared Facilities

Common spaces—including fitness centers, rooftop lounges, co-working spaces, and outdoor courtyards—are provided for tenant enjoyment.

  • Cleanliness: Tenants must clean up after themselves and leave common areas in pristine condition.
  • Reservations: Certain amenities may require booking via the Nook Tenant Portal prior to use.
  • Smoking Policy: All Nook properties are strictly non-smoking. Smoking, vaping, or the use of tobacco products is strictly prohibited inside units, balconies, and all indoor/outdoor common areas.

4.3 Pet Policy

Pets are only permitted in designated pet-friendly Nook properties and require prior approval.

  • Registration: All pets must be registered with management prior to move-in.
  • Leash Law: Pets must be kept on a leash or in an appropriate carrier when outside individual units.
  • Waste Removal: Pet owners must immediately clean up and dispose of pet waste in designated outdoor receptacles.

5. Maintenance, Alterations & Inspections

5.1 Maintenance Requests

Tenants must promptly report any physical defect, damage, or needed repair via the Nook Tenant Portal. Non-emergency repairs will be scheduled during standard business hours.

5.2 Emergency Maintenance

For urgent maintenance issues that pose an immediate risk to life, safety, or substantial structural damage (e.g., major water leaks, gas leaks, loss of heat during winter), tenants should contact the 24/7 Nook Maintenance Hotline immediately.

5.3 Alterations & Modifications

Tenants shall not make structural modifications, paint walls, change locks, or install fixtures without prior written consent from Nook. Any unauthorized alterations must be restored to original condition at the tenant's expense upon move-out.

5.4 Management Access

Nook management reserves the right to enter the unit for maintenance, safety inspections, or property showings. Except in emergency situations, Nook will provide at least twenty-four (24) hours' advance notice before entering an occupied unit.

6. Move-Out Procedures & Security Deposit Return

6.1 Notice to Vacate

Tenants must provide written notice of non-renewal or intent to vacate at least thirty (30) to sixty (60) days prior to the lease expiration date, as specified in the Lease Agreement.

6.2 Move-Out Inspection

Upon move-out, tenants must leave the unit in clean condition, removing all personal belongings and trash. A formal move-out inspection will be conducted to evaluate the unit's condition against the initial move-in checklist.

6.3 Deposit Deduction & Refund

Security deposits will be refunded within the statutory timeframe required by local law (typically 14 to 30 days) following lease termination and key return. Deductions may be made for:

  • Unpaid rent, utilities, or outstanding fees.
  • Cleaning costs required to return the unit to standard move-in condition.
  • Repairs for damage exceeding standard wear and tear.

7.1 Liability & Renters Insurance

Nook is not responsible for loss, theft, or damage to personal property resulting from fire, water damage, theft, or unforeseen events. Tenants are required to maintain a valid Renters Insurance policy with a minimum liability coverage of $100,000 throughout their tenancy.

7.2 Termination & Breach

Failure to comply with any provision of these Terms or the Lease Agreement constitutes a material breach. Nook reserves the right to issue cure-or-quit notices, assess administrative fines, or initiate formal eviction proceedings in accordance with applicable local, state, and federal laws.

7.3 Amendments

Nook reserves the right to update or modify these Terms as necessary. Tenants will be notified of material changes via email or the Nook Tenant Portal at least thirty (30) days prior to the effective date.

Acknowledgment

By accessing the Nook Portal or occupying a Nook property, you acknowledge that you have read, understood, and agreed to these Tenant Terms.

Acceptance of these Terms is recorded electronically against your Nook account when you activate it, including the version accepted and the date and time of acceptance.
